Private Sector Labour Law No. 6 of 2010 — Law No. 6 of 2010
Text and explanation of Article 53
For an open-ended contract, Article 53 sets a sliding scale for a resigning worker's share of the end-of-service indemnity, based on length of service:
A worker who resigns with less than three years of service gets nothing. With three to under five years, they get half the indemnity. With five to under ten years, they get two thirds. With ten years or more, they get the full indemnity.
Important: unexcused absence for seven consecutive days, or twenty separate days within a year, can be treated as resignation — meaning this article's reduced shares apply instead of the full indemnity.
