Article 47 of the UAE Labour Law: when dismissal is unlawful
Federal Decree-Law No. 33 of 2021 Regulating Labour Relations — In force since 2 February 2022
Text and explanation of Article 47
Under Article 47, an employer's termination of a contract is unlawful when it is caused by the worker filing a genuine complaint with the Ministry, or a lawsuit against the employer that proved valid.
Protection against unlawful dismissal therefore centres on preventing retaliation for a worker asserting their rights, not on any dismissal the worker considers unfair in general. Dubai and Abu Dhabi courts have applied this narrow reading in final judgments.
The court sets compensation for unlawful dismissal at no more than three months' wage, taking into account the type of work, length of service and the harm suffered. This compensation does not prevent the worker from separately claiming other entitlements such as the end-of-service gratuity, notice pay, and unpaid wages.
