Appeal Deadlines in the UAE: What Litigants Must Know

The UAE Civil Procedure Law sets short, strict deadlines for appeal and cassation. Missing them usually ends the case.

Why deadlines matter

In UAE onshore courts, appeal periods are mandatory. A late appeal is rejected on form, however strong the merits. The governing text is Federal Decree-Law No. 42 of 2022 on Civil Procedure.

The main time limits

• Appeal (الاستئناف): 30 days, generally running from the day after the judgment is issued (or from notification where the judgment was given in the absence of a party).
• Urgent matters: 10 days.
• Cassation (النقض): 60 days before the Federal Supreme Court or the relevant local Court of Cassation (Dubai, Abu Dhabi, Ras Al Khaimah).

Practical tips

1. Diarise the deadline the day the judgment is issued, not when you receive the reasons.
2. Check whether the judgment is final, preliminary or urgent; each has its own rules.
3. Pay the court fee and file electronically before the last day; system delays are not an excuse.
4. DIFC and ADGM courts follow their own common-law rules and permission-to-appeal regime.

How LexArab helps
