Labour claims in the Gulf: end-of-service rights, filing deadlines, and how to prepare the claim and documents
End-of-service gratuity, unpaid wages and unfair dismissal across the UAE, Saudi Arabia, Qatar, Kuwait, Bahrain and Oman: what the employee is owed, where to start and which documents are needed.
Labour claims are the most numerous before Gulf courts, and the most often lost through delay or missing documents rather than weakness of the right. A short practical guide.
What an employee is usually owed at the end of service
- End-of-service gratuity, calculated on the final wage and length of service; whether the basic or the total wage counts, and how resignation, dismissal or expiry affects the amount, differs by country.
- Unpaid wages and untaken leave.
- Notice pay where the contract was ended without notice.
- Compensation for unfair dismissal where there was no lawful reason.
- A return ticket in some countries.
Where to start
In most Gulf states the claim does not go straight to court. It starts with a complaint to the labour authority (the Ministry of Human Resources in the UAE, amicable settlement offices through Najiz in Saudi Arabia, the Ministry of Labour in Qatar, Kuwait, Bahrain and Oman) for a settlement attempt within a set period, then is referred to the labour court if no settlement is reached.
Deadlines
Limitation periods for labour claims are short, typically a year or less from the date the right fell due or the relationship ended, depending on the country. Delay extinguishes the claim; check the deadline as soon as service ends.
Documents you need
- The employment contract and any addenda.
- Payslips or bank transfers.
- Proof of start and end dates (appointment letter, termination letter, cancellation of the work permit).
- Correspondence about the termination or the demand.
- Salary certificate and labour card.
How LexArab helps
Choose the country and the dispute type (labour), describe the facts (start and end dates, wage, reason for termination), attach the contract and payslips. The assistant estimates the entitlements, drafts the complaint or statement of claim formally with the articles relied on, and flags the deadline. Then prepare the document bundle with the dedicated tool and download one file ready for filing.
Note: rules change, and some categories (domestic workers, free zones) have their own regimes. Always check the current text of the law in your country.
